Instructions To Instrument Of Distribution

• All signatures must be notarized (both sellers and buyers). Those not properly notarized will be returned.

• If all parties involved in the transfer are unable to appear before a notary at the same time, a separate notary acknowledgement may be attached for additional signatures.

• If more than one (1) name is used as New Owner, "OR" or "AND" must be specified between names.

• If ownership is being distributed to a business entity, signatures of two (2) authorized persons are required. A copy of the business organizational papers must be provided (i.e.: Articles of Incorporation, Partnership Agreement, Articles of Organization, etc.).

• The Personal Representative must sign to distribute ownership of the brand. Evidence must be provided showing the Personal Representative has the authority to act on behalf of the brand owner. (Death of Owner Brand Ownership Transfer Affidavit or other acceptable proof).

• If the Personal Representative is claiming ownership or partial ownership in the brand, he/she must sign under both Personal Representative and New Owner.

• A $25.00 fee must be submitted for the processing of each Instrument of Distribution and the issuance of a new Brand Certificate.

• An Instrument of Distribution does not change the expiration date of the brand.
